Violation Explanation

Official Report Wording, Item #43

Complete separation of living, sleeping and laundry from food and warewashing areas. (1 pt.)

Domestic living and sleeping areas are not compatible with the sanitary operation of commercial food establishments. If provided, these areas must be located separately from food operations to prevent potential contamination of food and food contact surfaces. The US Constitution ensures the right of persons to be secure in their homes against unreasonable search and seizure. This Constitutional right could hinder Health Department access to conduct routine inspections of a food establishment operated in the living areas of a private home.
