Release of "Criminal Justice Records" is governed by the Colorado Criminal Justice Act (CJRA), C.R.S. 24-72-301 et seq. Pursuant to the CJRA, a statutory fee of $25.00 per criminal case is assessed up front for records requests received by this office. Later, there may be copying ($.25/page) and other costs that will have to be paid before the records are released, if release is appropriate under the CJRA. Those additional costs may include the cost to redact out identifying information of certain victims/witnesses.
Once payment is received we will attempt to locate the records and review them in light of the criteria set-forth in the CJRA. To that end, when you send payment of the up front fees please complete a "Request for Criminal Justice Records" form in which you identify the reasons you are requesting the records. Your explanation may be helpful and, in some cases, essential to our determination of whether release of the requested records is appropriate.
If the "criminal justice records" concern charges that involve sexual assault allegations, and release is deemed appropriate, the CJRA requires that certain identifying information about the victim be redacted at your expense prior to release. If this specific law is applicable to your request we will send you a letter in which those costs will be explained. Payment of those costs must be received prior to the actual redaction and copying takes place.
If your request for "criminal justice records" involves a pending prosecution we may be unable to release any information until such time as there has been a disposition of the criminal case. In this event we will contact you directly and your records request would be kept open until that has occurred.
If you wish to pursue a request for "criminal justice records", please fill out Request for Criminal Justice Records form and submit it and a check or money order in the amount of $25.00, payable to the District Attorney; Eighth Judicial District. We will notify you whether or not records exist and if they can be released pursuant to the CJRA. If there are records which can be released, we will advise you of any copying and redaction costs, if applicable.
