MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT

(September 28, 2010)

 

 The regular meeting of the Larimer County Board of Adjustment was held in the County Board Hearing Room in the Larimer County Courthouse Offices, Fort Collins, Colorado at 7:00 p.m., September 28, 2010 at which time the following business was transacted.  

 

Board Members Present: Paul Devenny, Jeffrey Schneider, Alan Cram, Peter Bohling, and Carol Dowding

 

Staff Present:   Toby Stauffer and Deputy County Attorney Jeannine Haag

 

Minutes:  Peter Bohling moved and Carol Dowding seconded the Motion to approve the August 24, 2010 Minutes of the Larimer County Board of Adjustment as presented. Board members Paul Devenny, Jeffrey Schneider, Alan Cram, Peter Bohling, and Carol Dowding voted in favor of the Motion.  The Minutes were unanimously approved.

 

Findings and Resolutions:  

 

Carol Dowding moved and Jeffrey Schneider seconded the Motion to approve the Findings and Resolution for the Watts Setback Variance (#10-BOA0807).  Board members Paul Devenny, Jeffery Schneider, Alan Cram, Peter Bohling, and Carol Dowding voted in favor of the Motion.

 

Carol Dowding moved and Peter Bohling seconded the Motion to approve the Findings and Resolution for the Sapp Setback Variance (#10-BOA0808).  Board members Paul Devenny, Jeffrey Schneider, Alan Cram, Peter Bohling, and Carol Dowding voted in favor of the Motion.

 

Carol Dowding moved and Paul Devenny seconded the Motion to approve the Findings and Resolution for the Chevalier Setback Variance (#10-BOA0809).  Board members Paul Devenny, Jeffrey Schneider, Alan Cram, Peter Bohling, and Carol Dowding voted in favor of the Motion.

 

Paul Devenny moved and Carol Dowding seconded the Motion to approve the Findings and Resolution for the Pearson Setback Variance (#10-BOA0811).  Board members Paul Devenny, Jeffrey Schneider, Alan Cram, Peter Bohling, and Carol Dowding voted in favor of the Motion.

 

Paul Devenny moved and Peter Bohling seconded the Motion to approve the Findings and Resolution for the Bassler Setback Variance (#10-BOA0810).  Board members Paul Devenny, Jeffrey Schneider, Alan Cram, Peter Bohling, and Carol Dowding voted in favor of the Motion.

 

Other Business:

 

 Peter Bohling moved and Carol Dowding seconded the motion that Alan Cram be appointed chair of the Board of Adjustment.  The question was called and members Paul Devenny, Jeffrey Schneider, Alan Cram, Peter Bohling and Carol Dowding voted in favor of the Motion. The motion passed.

File No: #10-BOA0813  (Bottoms Setback Variance)

Owner:  Shalese Bottoms

Applicant: Cameron Abernathy

Request: The application of Cameron Abernathy, Shalese Bottoms appearing, requested a setback variance to allow a new garage to be 15 feet from the west property line rather than the required minimum of 25 feet in the R-Residential zone.

 

Action:  Peter Bohling moved and Paul Devenny seconded the Motion to approve the Application with conditions.  Board members Paul Devenny, Jeffrey Schneider, Alan Cram, Peter Bohling, and Carol Dowding voted in favor of the Motion.  The Application was approved with conditions. 

 

File No:  #10-BOA0805  (Kimmich Setback Variance)

Owner/Applicant: Heinz Kimmich, Jr.

Request: The application of Heinz Kimmich, Jr. requested a setback variance to allow a new garage to be 62 feet from the centerline of County Road 21 rather than the required minimum of 100 feet for a road classified as a major collector in the R-Residential zone.

 

Action:  Peter Bohling moved and Paul Devenny seconded the Motion to approve the Application with conditions.  Board members Paul Devenny, Jeffrey Schneider, Alan Cram, Peter Bohling, and Carol Dowding voted in favor of the Motion.  The Application was approved with conditions. 

 

File No:  #10-BOA0816  (Hancock Setback Variance)

Owner/Applicant: Doris Hancock

Request: The application of Doris Hancock requested a setback variance to allow a proposed pole barn to be setback 30 feet from an intermittent stream rather than the required minimum of 100 feet in the O-Open zone.

 

Action:  Peter Bohling moved and Paul Devenny seconded the Motion to approve the Application with conditions.  Board members Paul Devenny, Jeffrey Schneider, Alan Cram, Peter Bohling, and Carol Dowding voted in favor of the Motion.  The Application was approved with conditions. 

 

File No: #10-BOA0814  (Lower Poudre Canyon Setback Variance #2)

Owner:  Lower Poudre Canyon Association 

Applicant: Kiley Baham

Request: The application of Kiley Baham, architect Justin Larson appearing, requested a setback variance to allow a new building to be located 11 feet from the north property line rather than the required minimum of 25 feet and to be located 82 feet from the centerline of Highway 14 rather than the required minimum of 100 feet, and also a request to allow an existing building to be located 50 feet from Highway 14 rather than the required minimum of 100 feet in the O-Open zone.

 

 

Action:  Peter Bohling moved and Paul Devenny seconded the Motion to approve the Application with conditions.  Board members Paul Devenny, Jeffrey Schneider, Alan Cram, Peter Bohling, and Carol Dowding voted in favor of the Motion.  The Application was approved with conditions. 

 

 

Adjournment:  The meeting was adjourned at 7:15 p.m.
