MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT

(January 28, 2014)

 

            The regular meeting of the Larimer County Board of Adjustment was held in the County Board Hearing Room in the Larimer County Courthouse Offices, Fort Collins, Colorado at 7:00 p.m., January 28, 2014 at which time the following business was transacted. 

 

Board Members Present:         Jeffrey Schneider, Carol Dowding, Alan Cram, Sheri           Hofeling

 

Staff Present:                          Rob Helmick and Karin Madson, County Planners, and William G. Ressue, Senior County Attorney        

 

Minutes:  Carol Dowding moved and Sheri Hofeling seconded the Motion to approve the December 17, 2013, Minutes of the Larimer County Board of Adjustment as presented. Board members Jeffrey Schneider, Carol Dowding, Alan Cram and Sheri Hofeling voted in favor of the Motion.  The Minutes were unanimously approved.

 

Findings and Resolutions:  Carol Dowding moved and Jeffrey Schneider seconded the Motion to approve the following Findings and Resolutions: Smith/Sack Setback Variance (File #13-BOA0968).  Board members Jeffrey Schneider, Carol Dowding, Alan Cram and Sheri Hofeling voted in favor of the Motion.

 

 

Applications:

 

A.        Consent Applications

 

The following applications were approved by consent:

 

File No:           #13-BOA0970  (Carlson/Gitchel Setback Variance)

Owner:                        Connie Carlson & Loren Gitchel

Applicant:       Vaught Frye Larson Architects & Taylor Meyer       

 

Request: The Application of Vaught Frye Larson Architects and Taylor Meyer, requesting a variance was presented to the Board.  The Application requested a setback variance to rebuild and add additional building footprint to a home and deck(s) destroyed in the High Park Fire to be located 12 feet from the centerline of a stream rather than the required minimum of 100 feet in the O-Open zone

 

Action:  Carol Dowding moved and Sheri Hofeling seconded the Motion to approve the Application with the following conditions:

           

            1.         Failure to comply with any conditions of the variance approval may result in reconsideration of the use and possible revocation of the approval by the Board of Adjustment.

           

            2.         This approval shall automatically expire one year from the date of this Resolution unless prior to expiration the Applicants (a) take affirmative action consistent with this approval, OR (b) submit a written request showing good cause to extend the one year time limit.

 

3.         All future additions or buildings that would be within setbacks as defined in the Land Use Code must go through the proper County review and planning process prior to construction.

 

4.         After the applicant applies for a building permit but prior to foundation pour, the Larimer County Building Department must be provided with a written certification by a Colorado Licensed Land Surveyor that the proposed structure is located where shown on the Larimer County approved Plot Plan for this Department.

 

            5.         The applicant shall incorporate erosion control measures and re-vegetate the site consistent with the recommendations of the Engineering Department. 

 

Board members Jeffrey Schneider, Carol Dowding, Alan Cram, and Sheri Hofeling voted in favor of the Motion.  The Application was approved with conditions. 

 

 

File No:                       #12-BOA0886  (Romero Setback Variance Extension)

Owner/Applicant:       Charlene Romero       

 

Request:   The Application of Charlene Romero, requesting a one-year time extension to comply with the conditions of approval of the original Romero 720 Setback Variance (File #12-BOA0866) that allowed an existing house and covered walkway, i) to be located 12 feet from Kimberly Drive rather than the required minimum of 20 feet, ii) to be located 4.7 feet from the side lot line rather than the required minimum of 7 feet, and iii) to be located 23.5 feet rather than the required minimum of 25 feet from the rear property line in the R-1 Residential zone.

 

Action:  Carol Dowding moved and Jeffrey Schneider seconded the Motion to approve the Application with the following conditions:

           

1.    Failure to comply with any conditions of the variance approval may result in reconsideration of the use and possible revocation of the approval by the Board of Adjustment.

 

2.    This extension shall automatically expire on May 30, 2014 unless the applicant takes affirmative action consistent with this approval.

 

3.    This variance is only for the building(s) as submitted with this variance application.  All future buildings, additions, and improvements must meet County setback requirements.

 

4.         The applicant shall apply for a building permit for the covered porch/walkway addition no later than May 30, 2014.

 

Board members Jeffrey Schneider, Carol Dowding, Alan Cram and Sheri Hofeling voted in favor of the Motion.  The Application was approved with conditions. 

 

Adjournment:  The meeting was adjourned at 7:10 p.m.
