MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT

(January 25, 2011)

 

            The regular meeting of the Larimer County Board of Adjustment was held in the County Board Hearing Room in the Larimer County Courthouse Offices, Fort Collins, Colorado at 7:00 p.m., January 25, 2011, at which time the following business was transacted. 

 

Board Members Present:         Timothy Jaworski, Peter Bohling, Alan Cram, Carol Dowding, and Jeffrey Schneider

 

Staff Present:                          Planner Toby Stauffer and Deputy County Attorney Jeannine Haag

 

Minutes:  Peter Bohling moved and Carol Dowding seconded the Motion to approve the December 28, 2010 Minutes of the Larimer County Board of Adjustment as presented. Board members Timothy Jaworski, Peter Bohling, Alan Cram, Carol Dowding, and Jeffrey Schneider voted in favor of the Motion.  The Minutes were unanimously approved.

 

Findings and Resolutions:  Carol Dowding moved and Peter Bohling seconded the Motion to approve the following Findings and Resolutions:  Ortiz Setback Variance (#10-BOA0830), Rudolph Setback Variance (#10-BOA0832), Basiliere Setback Variance (#10-BOA0834), Roukema Setback Variance (#10-BOA0833), Covelli Setback Variance (#10-BOA0831), and  Freeman Setback Variance (#10-BOA0835).  Board members Timothy Jaworski, Peter Bohling, Alan Cram, Carol Dowding, and Jeffrey Schneider voted in favor of the Motion.

Owner:  Luther Cole

Applicant:  Van Horn Engineering / Joe Coop

Request:  The Application of Van Horn Engineering and Joe Coop, requesting a variance was presented to the Board.  The Application requested a setback variance to allow a new house to be built 42 feet from the centerline of Highway 34 rather than the required minimum of 100 feet, and to be located 22 feet from the right-of-way line rather than the required minimum of 50 feet in the O-Open zone.

 

Action:  Carol Dowding moved and Peter Bohling seconded the Motion to approve the Application with conditions.  Board members Timothy Jaworski, Peter Bohling, Alan Cram, Carol Dowding, and Jeffrey Schneider voted in favor of the Motion.  The Application was approved with conditions. 

 

 

 

 

 

File No: #10-BOA0838  (Kaltenberger Setback Variance)

Owner:  Douglas Kaltenberger

Applicant:  Douglas Kaltenberger

Request:  The Application of Douglas Kaltenberger, requesting a variance was presented to the Board.  The Application requested a setback variance to allow an existing building to remain located 60 feet from Highway 14 rather than the required minimum of 80 feet from the right-of-way line and also an addition to the building to be located 4 feet from the side lot line rather than the required minimum of 10 feet in the C-Commercial zone.  Board member Cram noted that the property is located within the FEMA designated 100-year Flood Fringe and also that access for emergency/fire personnel are important issues that must be addressed.  Staff noted that these issues will be addressed by other County and agency staff during the site plan review and building permit processes.

 

Action:  Peter Bohling moved and Carol Dowding seconded the Motion to approve the Application.  Board members Timothy Jaworski, Peter Bohling, Alan Cram, Carol Dowding, and Jeffrey Schneider voted in favor of the Motion.  The Application was approved with conditions. 

 

 

 

Adjournment:  The meeting was adjourned at 7:25 p.m.
